1. General

1.1 The following terms and conditions apply to all sections and pages under the www.moneyadviceservice.org.uk website (the “Money Advice Service website”) and, where relevant, to other services provided by us. Additional terms and conditions may also apply to other services provided by us and these are set out below and/or will be explained or made available to users of such services.

1.2 All tools and information available on the Money Advice Service website provide a free resource and, subject to Clause 4 below (special conditions applying to the compare products section), may not be used for commercial purposes of any kind without the prior written consent of the Money Advice Service.

1.3 By accessing any part of the Money Advice Service website you will be deemed to have accepted these terms in full.

1.4 The Money Advice Service may modify these terms and conditions by posting an updated copy of them on the Money Advice Service website from time to time. You should check the Money Advice Service website from time to time to review the then current terms and conditions. By continuing to use the Money Advice Service website you agree to the amended terms and conditions. Certain provisions of these terms and conditions may be replaced by clear notices or new terms located on particular pages of the Money Advice Service website.

1.5 You will not use the Money Advice Service website for any purpose that is unlawful or prohibited by these terms and conditions

1.6 You are prohibited from posting or transmitting to or from the Money Advice Service website any material:
(a) that is threatening, defamatory, obscene, indecent, seditious, offensive, pornographic, abusive, liable to incite racial hatred, discriminatory, menacing, scandalous, inflammatory, blasphemous, in breach of confidence, in breach of privacy or which may cause annoyance or inconvenience, or
(b) for which you have not obtained all necessary licences and/or approvals, or
(c) which constitutes or encourages conduct that would be considered a criminal offence, give rise to civil liability, or otherwise be contrary to the law of or infringe the rights of any third party, in any country in the world, or
(d) which is technically harmful (including, without limitation, computer viruses, logic bombs, Trojan horses, worms, harmful components, corrupted data or other malicious software or harmful data).

1.7 You may not misuse the Money Advice Service website (including, without limitation, by hacking).

1.8 The Money Advice Service shall fully cooperate with any law enforcement authorities or court order requesting or directing the Company to disclose the identity or locate anyone posting any material in breach of clause 1.6 or 1.7.

1.9 Any contractual and non-contractual obligations and other matters arising from or connected with these terms and conditions shall be governed by English law and these terms and conditions shall be construed in accordance with English law.

1.10 The courts of England and Wales shall have exclusive jurisdiction to settle any dispute which may arise out of or in connection with these terms and conditions.

1.11  Any provision of these website terms and conditions which is, or may be, void or unenforceable shall, to the extent of such invalidity or unenforceability, be deemed severable and shall not affect any other provision of these website terms and conditions.

2. Copyright

2.1 Unless otherwise stated the Money Advice Service owns the copyright and any other intellectual property rights in all material on the Money Advice Service website and publications.  

2.2 Subject to Clause 4 below (special conditions applying to the compare products section) the Money Advice Service gives permission for extracts of our website (of up to 10,000 words) to be printed, saved to disk or downloaded to any other storage medium, provided:

2.2.1 It is for your own personal use, or for use within a charity or not-for-profit organisation and is not for a commercial purpose of any kind

2.2.2 No text or related graphics are modified in any way

2.2.3 Graphics are not used separately from the accompanying text, and

2.2.4 The source of the material is acknowledged in all copies, either by appropriate words or by adding the Money Advice Service copyright notice (ie the Money Advice Service™).

2.3 Charities and not-for-profit organisations may give copies of extracts, as described in Clause 2.2 above, from the Money Advice Service website to consumers incidental to advice and other activities. These extracts can be given in any form appropriate to the advice or other activities – e.g. printed paper, by fax, email or other electronic means.

2.4 The information on the Money Advice Service website may also be used, after receiving written agreement us, by the providers of other websites or publications to help them develop their own content. Such approvals will be granted subject to status of the provider, reasons for use and current Money Advice Service editorial policies. Any additional requirements will be agreed at the time of approval between the requestor and us, and in most cases will vary the terms of this Copyright section. Written agreement requests may be submitted via email to enquiries@moneyadviceservice.org.uk or by letter to ‘The Consumer Information team’ at the Money Advice Service registered address.

2.5 For consumer publications, we are happy for firms to distribute it to consumers, provided they:

  • make it clear that the publication has been produced by the Money Advice Service;
  • do not state or imply that the Money Advice Service or the Financial Services Authority (FSA) endorses any of their products or services; and
  • only distribute originals, not photocopies or reproduced versions.

2.6 For consumer publications artwork in the form of InDesign files is available for specific titles. The publication must be reproduced without variations in layout, pagination, design, font and colours and with no omissions or additions. A sample copy will be sent on application for artwork.

2.7 Any rights not expressly granted in these terms are reserved.

3.6 The Money Advice Service website, associated publications (available through download or order form at free printed guides), and the advice given by our advisors via the Money Advice Line and/or face-to-face sessions aim to give you general information and money advice to help you manage your money better and make informed choices, and are intended for customers of UK financial services who live in the UK.

3.6.1 We are not regulated by the Financial Services Authority. Accordingly, the information and tools provided are not regulated financial advice, nor can they take account of your own particular circumstances or recommend specific products for you.

3.7 We sometimes provide case studies in our website content and publications. When we do they are generally based on real-life situations, but we change the names of individuals and any identifying information.

3.8 We do not control other websites linked to or from the Money Advice Service website and we are not responsible for the contents of them, or any changes or updates to such websites.

3.8.1 We are not responsible for webcasting or any other form of transmission received from any other websites.

3.8.2 We provide you with links to other websites only as a convenience, and our inclusion of links to them does not imply our endorsement of their content or services.

3.8.3 We are not responsible or liable for the content of any linked websites not within our control.

3.9  While we try to ensure that the Money Advice Service website is normally available 24 hours a day we are not liable if, for any reason, the site is unavailable for any period of time.

3.9.1 Access to the Money Advice Service website may be suspended temporarily or permanently and without notice.

3.10 We do not, of course, exclude any liability we may have in the unlikely event we have been fraudulent or if we are negligent and as a result cause your death or personal injury in connection with your use of this website or its associated publications or any of the information on the website or any advice provided via the Money Advice Line or at face-to-face sessions.


4. Special additional terms and conditions applying to the Compare products section

4.1 You can print or save to disk or any other storage medium copies of the comparison tables from the Money Advice Service website on the following conditions. These apply in addition to, or (where indicated) in place of, the other conditions specified in these terms and conditions.

4.2 If you intend to publish the comparison tables, to use them in promotions, advertising or product literature or in some other form in the public domain, then you must comply with the following terms:

4.2.1 The Money Advice Service’s copyright notice (i.e. ©) must appear in all copies;

4.2.2 The date that we last updated the information (as indicated on the Money Advice Service website) must be stated clearly on all copies, with the website address www.moneyadviceservice.org.uk/tables, for example “Information taken from the Money Advice Service website (www.moneyadviceservice.org.uk/tables), as at [date]”.

4.2.3 The publication must not imply Money Advice Service endorsement of any company or product or of any conclusions drawn from the data.

4.2.4 Any comparison tables must either:

(a) be presented complete and with no additions, or

(b) if one or more comparison tables is not complete, state that the information is based on a limited selection taken from the tables prepared by the Money Advice Service as at a particular date; for example "Selected from a total of [total number of products shown on website or printed table] products as at [date]".

4.2.5 If you include additional data, you must distinguish it from the data provided by the Money Advice Service and clearly identify its source.

4.2.6 If you present our data in non-alphabetical order, you must make clear the basis for the way you have ordered it and must not indicate or imply any Money Advice Service endorsement of the ordering.

4.3 Information from the Money Advice Service comparison tables is freely available for research. However, if you use or quote this material to a client in connection with a financial product or service, then – in addition to complying with the conditions in 4.2 above – you must give the client a print of the appropriate comparison table. This should be:

4.3.1 as filtered and sorted by you

4.3.2 complete in that it should include all products that remain after filtering, not just any you have shortlisted

4.3.3 accompanied by the supporting introduction and column explanation pages, and

4.3.4 as created using the print function on this website, without amendment.

4.4 You must not use data from the Money Advice Service comparison tables to provide a data feed to any comparison table or to any website.


5. Special additional terms and conditions applying to the health check

5.1 All users of the health check are subject to the standard Money Advice Service terms and conditions. By using the health check, you will be deemed to have accepted these terms in full.

5.2 The health check will give you information and advice to help you identify your financial needs and manage your money better. It provides a personal action plan which is based on the information that you give us about your current financial circumstances.

5.3 The health check action plan will set out your financial needs in an order of priority that is likely to be sensible for most people - but it is not a substitute for you thinking about how this relates to your own circumstances and priorities. And, remember, it is a good idea to review your finances from time to time, especially when your circumstances change.

5.4 We’re not regulated by the Financial Services Authority so the health check won’t give you a specific recommendation on whether a particular product is suitable for you. So don’t buy, sell or change the terms of a product purely on the basis of this health check. If you need regulated financial advice, consult a professional financial adviser.

5.5 If you are using the health check with an adviser, we do not endorse any conclusions they may draw from it or recommendations they make to you. If you can, it's a good idea to get a printed copy of your health check feedback from your adviser.

5.6 If you are using the health check to advise someone, we cannot endorse any conclusions you may draw from it or recommendations you make to them, nor should you let them assume any such endorsement. 6.1 The Money Advice Service records calls made to the Money Advice Line for quality control, evaluation and training purposes.
